Status of Discipline January - March '14

Good order and discipline is absolutely essential for the 460th Space Wing and Team Buckley partners to accomplish our mission of national defense and security. Below is information on cases processed by 460th Space Wing legal office in the January - March timeframe. Those cases included nonjudicial punishment and administrative separation.

A military member is subject to nonjudicial punishment under Article 15, Uniform Code of Military Justice for a violation of the UCMJ. Maximum punishment may include reduction in rank and forfeiture of pay.

- An E-5 engaged in disorderly conduct off-base and lied to his first sergeant about it. Punishment consisted of reduction to E-4 suspended, 14 days extra duty, and a reprimand.

- An E-5 wrongfully possessed controlled test material. Punishment consisted of reduction to E-4, forfeiture of $1,164, and a reprimand.

- An E-4 wrongfully possessed and distributed controlled test material. Punishment consisted of reduction to E-3 suspended, forfeiture of $1,017 per month for two months, and a reprimand.

- An E-4 wrongfully possessed, reproduced, distributed, or communicated controlled test material. Punishment consisted of reduction to E-3, forfeiture of $1,017 per month for two months, and a reprimand. He was subsequently discharged.

- An E-2 engaged in housebreaking and wrongfully appropriated a wallet. Punishment consisted of reduction to E-1, 21 days restriction to base suspended, and a reprimand.

A military member is subject to involuntary separation if the member does not show a potential for further service. The most common bases for discharge are misconduct and unsatisfactory performance. A discharge can be characterized as honorable; under honorable conditions (general); or under other than honorable conditions.

- An E-4 was discharged with a general characterization after he willfully failed to report information to his security office, lied to his supervisor, and wrongfully solicited a subordinate to lie. He also repeatedly left work without authorization, left an unqualified technician alone on duty, and did not wear a uniform while on duty.

- An E-3 was discharged with a general characterization after he failed three fitness assessments; possessed, reproduced, distributed, or communicated controlled test material; failed to follow proper procedures at work; slept on duty and lied about it; and misused his controlled spending account card and was delinquent on payment.

- An E-2 was discharged with a general characterization after he was drunk on duty and drove under the influence of alcohol.

- An E-2 was discharged with an honorable characterization after he failed a fitness assessment four times in a 24-month period.
