Buckley reports on status of discipline Published Feb. 13, 2014 By 460th Space Wing Office of the Staff Judge Advocate BUCKLEY AIR FORCE BASE, Colo. -- Good order and discipline is absolutely essential for the 460th Space Wing and Team Buckley partners to accomplish their mission of national defense and security. Below is information on cases processed by 460th SW staff judge advocates from October to December 2013. Cases include trial by court-martial, non-judicial punishment and administrative separation. Courts-martial are done when a military member is subject to trial by court-martial for a violation of the Uniform Code of Military Justice. Maximum punishment may include confinement and a punitive discharge. - An E-5 was found guilty of breaking into a government warehouse, stealing government property, such as backpacks, batteries, gloves, rifle cases, bags, and body armor plates and misusing his government travel card. A panel of officers adjudged a sentence of reduction to E-3, 18 months confinement and a bad conduct discharge. The findings and sentence are subject to the approval of the convening authority. Non-judicial punishment happens when a military member is subject to non-judicial punishment under Article 15, UCMJ. Maximum punishment may include reduction in rank and forfeiture of pay. - An E-9 was found guilty of drunk driving. He was arrested after a caller reported to the police that his vehicle was weaving on and off the road. Punishment consisted of reduction to E-8, forfeiture of $1,500 pay per month for two months suspended and a reprimand. - An E-5 was found guilty of failure to go to work, lying about being at medical appointments instead of work and asking an officer to lie about the medical appointments. Punishment consisted of reduction to E-4 and a reprimand. - An E-5 was found guilty of dereliction of duty when he made sexual comments to a subordinate and wrongfully appropriating the subordinate's clothing. Punishment consisted of reduction to E-4, forfeitures of $1,152 suspended and a reprimand. - An E-5 was found guilty of dereliction of duty for failing to report financial troubles as required for his security clearance, lying about being at work and in uniform, and asking a subordinate to lie. Punishment consisted of reduction to E-4 and a reprimand. - An E-4 was found guilty of failure to be at work on time. Punishment consisted of reduction to E-3 and a reprimand. - An E-3 was found guilty of failure to obey a lawful order when he did not schedule or complete his fitness assessment. Punishment consisted of reduction to E-2 suspended, forfeiture of $200 pay per month for two months, 14 days extra duty and a reprimand. - An E-3 was found guilty of failure to be at work on time, underage drinking and lying about his location. Punishment consisted of reduction to E-2, forfeiture of $849 pay per month for two months suspended and a reprimand. - An E-3 was found guilty of being drunk on duty. Punishment consisted of reduction to E-2, 14 days extra duty suspended and a reprimand. - An E-3 was found guilty of dereliction of duty when he drove a motorcycle without completing a motorcycle rider education course and lying about it. Punishment consisted of reduction to E-2, forfeiture of $500 pay per month for two months suspended and a reprimand. Administrative separation happens when a military member is subject to involuntary separation if the member does not show a potential for further service. The most common basis for discharge are misconduct and unsatisfactory performance. A discharge can be characterized as honorable, under honorable conditions (general) or under other than honorable conditions. - An E-5 was discharged with an honorable characterization after he failed four fitness assessments in 24 months. - An E-5 was discharged with an honorable characterization after he failed four fitness assessments in 24 months. - An E-4 was discharged with a general characterization after he made sexually harassing comments towards a subordinate, failed to wear the correct gear while on duty, threatened a subordinate, handled a weapon inappropriately, damaged another person's property, failed to display a restricted area badge in a restricted area and slept on duty. - An E-3 was discharged with a general characterization after he failed to go to a commander's call and fitness assessment failed to report to work on time on multiple occasions and failed to complete his fitness assessment on time. - An E-3 was discharged with an honorable characterization after he twice failed his career development course exam.
