Buckley reports on status of discipline Published Nov. 7, 2013 By 460th Space Wing Office of the Staff Judge Advocate BUCKLEY AIR FORCE BASE, Colo. -- Good order and discipline is absolutely essential for the 460th Space Wing and Team Buckley partners to accomplish the mission of national defense and security. The following information are cases processed by the 460th SW staff judge advocates from July to September. Cases include trial by court-martial, non-judicial punishment and administrative separation. · Court martial are done when a military member is subject to trial by court-martial for a violation of the Uniform Code of Military Justice. Maximum punishment may include confinement and a punitive discharge. · An E-5 was found guilty of cocaine use on multiple occasions. A panel of officers adjudged a sentence of reduction to E-4, restriction to base for 30 days, hard labor without confinement for 30 days and a bad conduct discharge. Note: The findings and sentence are subject to approval by the convening authority. · Non-judicial punishment happens when a military member is subject to non-judicial punishment under Article 15, UCMJ. Maximum punishment may include reduction in rank and forfeiture of pay. · An E-4 was found guilty of failure to go to the appointed place of duty when she did not report for work on time. Punishment consisted of reduction to E-3 and a reprimand. · An E-3 was found guilty of failure to go to the appointed place of duty when he did not report for work on time. Punishment consisted of reduction to E-2 suspended for six months, restriction to base for 14 days, extra duty for 14 days and a reprimand. · Administrative separation happens when a military member is subject to involuntary separation if the member does not show a potential for further service. The most common bases for discharge are misconduct and unsatisfactory performance. A discharge can be characterized as honorable, under honorable conditions (general) or under other than honorable conditions. · An E-7 was discharged for unsatisfactory performance with an honorable characterization after he failed four fitness assessments within 24 months. · An E-4 was discharged for misconduct with a general characterization after he was convicted by civilian authorities for driving under the influence of alcohol, failed the Alcohol and Drug Abuse Prevention and Treatment program, and repeatedly failed to report for duty on time. · An E-4 was discharged for unsatisfactory performance with an honorable characterization after he failed four fitness assessments within 24 months. · An E-3 was discharged for misconduct with a general characterization after she repeatedly failed to report for duty on time and also failed four fitness assessments within 24 months. · An E-3 was discharged for unsatisfactory performance with an honorable characterization after he twice failed a Career Development Course end-of-course exam. · An E-3 was discharged for drug abuse with a general characterization after she used marijuana on multiple occasions.
